There is nothing to be pissed about. Even if you aren’t at fault you file a claim with your insurance. They will then do their own investigation and once it’s determined that you have zero fault they will go after the insurance of the ambulance company. Your attorney will seek additional damages from the insurance company. Your rates won’t go up.

I finally decided to go with this lawyer he told me to do the physical therapy sit back and they will take care of everything. So at the clinic the woman at the desk was upset I didnt file a claim with my insurance.I said im not filing a claim with my insurance because im not at fault and the police report supports that she said it doesnt matter i have to file a claim with my insurance regardless of whose at fault...

She gets in contact with my lawyer two days later i get a message from my insurance saying a claim was filed..wtf...I thought my lawyer was going to go after the ambulance's insurance company! Not MY insurance! I didnt want a claim on my record my insurance is high enough!

My brother just laughed and told me my insurance rate is going to sky rocket next year because of this claim.

No one told me my insurance was going to be involved in this.I was under the inpression that I was to do thr physical therapy/ dr appointments then once im better they would file a claim on the other party's insurance to get paid.

Im aggravated with the whole situation now and o cant even say screw it im done because ive went to too many physical therapy and chiropractor appointments I would be on the hook for the bill...Im so upset.I dont need my insurance any higher than what it is.

Fyi it wasnt a city ambulance it was a private ambulance company.

If you are not at fault then your insurance shouldn't go up just because you filed a claim. We've had a couple incidents where we were not at all at fault and we still called our own insurance anyway. One didn't even involve our car at all. My DH was hit as a pedestrian, but our vehicle insurance is still involved to help cover medical costs. Especially because it looks like the lady who was driving and hit DH doesn't have enough coverage to cover his medical costs, so our own insurance will cover the shortage under something called "underinsured coverage".

It's the reason you have insurance in the first place, to cover your bills in just such an incident. It's not just for when you are at fault.

If you have a good insurance company you don't need an attorney to explain all this to you. Your adjuster can explain it all to you. But of course only if you actually call them and tell them about the incident.

You can still file a claim with your health insurance and auto insurance. Just because you have a claim against the ambulance company doesn't mean that you cannot file a claim with your health or auto insurance. They will in turn file a claim against the ambulance company to reimburse them for the cost. Whenever I've been hit by another vehicle, I always file a claim with my health insurance and let them go after the other company. It's a lot less hassle.
