I am sorry, and now you have to deal with getting rid of the tree. Such a pain.
If your water table has been high, it's highly possible that is what caused it to topple. We had a water oak do that once. We did earlier, in April and May, but I don't think it was more than usual for our season. I could be wrong. I know it's not been as hot as our summers can be.
That tree really doesn't look dead or dying. Did you see the link?

I'm sorry to hear about your tree dying. Will you plant another one?
We'd be very upset if anything happened to our trees, Thelma and Louise. They are huge trees and our local wild birds love them, as well as the local tree rats (squirrels).
We have a large raspberry bush in the back as well. Many of our local wild birds like those, too. No matter, there are plenty of raspberries for everyone!
