It isnt good for a baby to be passed around like a hot potato
Under this rock judges give parents 50/50 custody, unless there is a reason not to. The baby being three weeks old would not be a reason

The baby will be fine. They are going every other week between two people, not a new person everyday. Lots of babies go to daycare and go between the center and their home and are all fine.

Most babies who go to daycare go home to the same home and parent each day. Babies deserve that security. With the scenario OP described, the daycare workers will be the most constant figures in the baby's life. That's not right.

They do both work but DD is on maternity leave right now

They should work out between themselves time to spend with the baby during the other parent's week. If they can do that, this sounds like the best custody arrangement for all three of them.

It is odd because we’ve come a long way to ensure that women can breast feed if they choose. That’s too bad

Sorry, but just because mom makes the choice to breastfeed, does not mean that dad doesn't get equal time. If they are both good parents, they can figure it out. If he was the one cheating she doesn't get to punish him with time with his child. If she was the one who cheated she doesn't get to punish him with time with his child.
